Visa with Canada

Are you married on paper and have a married ID and a contract?‌

Yes.

Your partner in the immigration system is called Spouse, and your spouse can apply for a mobile visa.

No.

If you have a partner with whom you have lived for 12 months like a couple under the same roof and are emotionally dependent but do not have an official registration, you are Common law partner and your partner or partner can accompany you and get a Canadian partner visa.

Common La partner is a person with whom you have lived under the same roof for 12 months and have a close relationship emotionally and in all respects. Children

Children under 22 years of age who are single are your dependent children. If your children are over 22 years old but are financially dependent on you because of a physical or mental problem, your children are still dependent.

What is the Minor child in the definition of immigration?‌

Any child who has not yet reached the legal age is known as a minor child. Legal age varies from province to province. In Alberta, Manitoba, Ontario, Prince Edward Island, Quebec and Saskatchewan, the legal age is 18. If in British Columbia, New Brunswick, Newfoundland and Labrador, the Northwest Territories, Nova Scotia, Nunavut and the Yukon, the age of 19 is considered legal.

Young children who have previously lived with at least one of their parents who have been allowed to study or work in Canada do not need to be allowed to attend school in preschool, primary or secondary schools. However, as soon as the child reaches the legal age in the province of his residence, he must receive permission to continue his studies in Canada.

 


Parents

Parents of a Canadian student or student are also considered companions. Consider the following two modes:

Canadian student’s parent visa

If you have a child of school age and under the age of 18, you are allowed to accompany your student child under Canadian government law. So you can accompany your child to Canada by obtaining a Canadian student’s parent visa, which is a tourist visa. 

To apply for a tourist visa, you can either submit your application at the same time as your child’s student visa application, or you can apply for a Canadian tourist visa after your child has obtained a Canadian student visa and entered Canada. 

Canadian student parent visa 

If your child is over the age of 18 and has a Canadian student visa, you can travel to Canada to visit and join them by obtaining a Canadian student’s parent visa. The Canadian student’s parent visa is the same as a tourist visa, but the purpose of this type of tourist visa is to visit the student’s child. 

Unlike a Canadian student visa, you cannot apply for a tourist visa at the same time as your child’s student visa application. You have to wait for your children to get a student visa, enter Canada, and then apply for a tourist visa with you.

Visitor or tourist visa with Canada

Your spouse can apply for a Canadian tourist visa at the same time or after you have received your visa. It is sufficient to apply for your student visa.

When the student’s spouse arrives in Canada, the border officer decides to allow the spouse to stay in Canada for a certain period of time. If the day is your day, the officer will issue a permit to stay until the end of the permit master. In this case, your spouse’s approval license will be a record visitor. The visitor will set the record for your departure from Canada.

With the position of the visitor your spouse is not allowed to study or work in Canada.

What is the difference between a record visitor and a visa visitor? 

Visitor visa relates to your permission to enter Canada and visitor record relates to the date of your departure from Canada. These two are completely different.

 


Canadian work visa

From inside or outside Canada, it is possible to take action for the spouse’s open work permit. There is no job offer required for a Canadian spouse’s work permit. 

With open work permit, you can do full-time work. Note, however, that there are restrictions on certain occupations, such as health group occupations or school education, that are included in the work permit. 

 Usually, a work permit has a time validity level equal to the permit master.

 


Conditions for obtaining a work visa for a student’s spouse Open work permit

Your spouse is a full-time student. 
Your spouse is accepted or is studying in an academic course. If they are studying in prerequisite courses such as language courses, you cannot apply for a spouse’s work visa. 

Open work permit from inside or outside Canada?

Both are possible. If you’re applying from outside Canada, just like the person who receives the permit Master, you’ll get a Poe letter that issues the permit work officer by presenting it at the border. 

If you apply from inside Canada, you apply for a tourist visa online or by visiting one of Canada’s immigration borders.

What is the advantage of openwork permit?

Open Work Permit allows the holder to work for any employer in Canada and no longer need an LMIA or job offer. However, a freelance work permit may have exceptions in performing certain occupations that require maintaining public health; unless the applicant undergoes immigration medical examinations. 

In this way, not only the spouse or partner of the student will get the valuable opportunity to work in Canada, but will also be more successful in financing his family.

 


Canadian student visa

If your spouse intends to study more than six months, they should apply for a permit master’s degree. Permit professorship application rules vary from inside and outside Canada. If you are applying for a permit from inside Canada, you must first complete the prerequisite course and then apply for a permit master.

 


How to apply for a Canadian visa

As a spouse, dependent children or parents of an international student, you can apply for a work visa or a tourist visa at the same time as applying for a student visa, or you can apply for a student visa separately after your spouse or child has received a Canadian student visa.

The steps for applying for a Canadian visa are somewhat different simultaneously or separately, which we will explain below.

Apply for a Canadian visa at the same time

In this case, the main applicant is your student’s visa application, spouse or child, and you are the person accompanying the main applicant. Therefore, the main visa application will be for a Canadian student visa, and at the time of filling out the application and answering the questions, you must state that you will accompany the main applicant as a spouse or dependent child or parents on a trip to Canada. You should also specify the type of visa you are applying for (work or tourist) while answering questions.

Step one: prepare the necessary documents

Prepare all the documents required for a Canadian student visa, plus all the documents required for a Canadian accompanying visa, and arrange them as Pdf and named Files. In the next sections of the article, we will explain in detail the documents required for a Canadian visa. 

All files except the photo file must be in pdf format and not more than 4 MB in size.

Step two: create an online account on the CIC site

Go to the Immigration Canada website and answer two questions on the page that opens in the Apply Online section:

The first question asks you if you are acting from inside Canada, outside Canada or at the border of entry.

Choose the right option for you:

 


Then answer the second question: Do you apply online or in paper form?

Based on your answer, the necessary instructions will be displayed, and at the bottom of this page you must click on the Create an Account or Sign In option.

 


After logging into the new page of the four available options, click don’t have an account and create an account.

 


Then you need to enter your first and last name, email address and date of birth, and then you will be presented with a set of questions that you must answer correctly. According to your answers, you will be shown the titles of the forms and documents you need at the end. Any wrong response leads to the display of the wrong evidence.

Step Three: answer the questions in the app.

After you have created an account and logged into the main app, you will be presented with the following screen. Your spouse, who is the main applicant for a Canadian student visa, must choose the first option, Visitor visa, Study and/or work permit.

 


After selecting the first option, you will be shown a set of questions. The audience for all questions is the main applicant, your spouse. At first, the following two main years are asked. From there, the main applicant applies for a Canadian student visa, and in answer to the first question, he must select Study and in answer to the second question, he must select Temporary – more than 6 months.

 


These questions are followed by a series of other questions asked by the student visa applicant. After completing the questions about the main applicant and determining the type of visa he or she has under the name Student Visa, other questions arise, including ” Are you planning to submit a visa application for a family member?”

As shown below, when you are going to accompany him as a Canadian student’s wife, you should therefore select Yes in the answer to this question.

 


After answering the above question, another question is asked, ” why is the accompanying person planning to go to Canada?” In answer to this question, if you are going to accompany your student’s spouse to Canada on a work visa, then you must select Work with an Open Work Permit from the suggested options as shown below:

 


But if your intention is to accompany your spouse for a short period of time, you should therefore apply for a mobile tourist visa and select Visit-All other types as shown below:

 


Following this question, other questions are asked about the companion, all of which you should answer correctly. 

If you have a child who is going to Canada with you and your student’s spouse, you should apply for a visa and specify the type of visa you are applying for. 

So you’re asked the following question, and the main applicant is asked, ” Do you want to submit a visa app for another family member?” 

If you have a child the answer will be Yes but if you don’t have a child choose answer No as shown below:

 


After answering all questions about the main applicant and his / her companions, a list of documents and forms for the student visa and accompanying visa will be displayed.

Step four: upload the required forms and documents to the online app

According to the answers you have given, the forms and documents related to the student visa for the main applicant and the Open Work Permit Visa or the tourist visa for the accompanying persons are displayed separately. 

You need to download the forms for each applicant, then fill in and sign them and upload them to the app in the appropriate place. 

Upload the necessary documents that you have prepared and categorized in advance, each in its own place. 

Step Five: pay for the app and submit it.

After uploading the documents, it enters the final step, which is to pay for the app or app. If you have not done Canadian fingerprinting, you must pay for Canadian fingerprinting at this stage, along with the visa application fee.

It should be noted that children under 14 do not need to be fingerprinted and paid for. 

Step Six: do the fingerprinting of your Canadian visa

After submitting the app, a letter called Biometric Instruction Letter will be sent to you in a few hours to a few days, using the information in it to make an appointment at a Canadian fingerprinting centre and perform the Canadian fingerprinting process on the appointed day.

Since the Canadian embassy is not present in Iran, so for fingerprinting, you should go to the neighboring countries of Iran where the Canadian embassy is located and do your biometric process in the VAC offices. 

Biometrics is required if you have not done any fingerprinting of Canadian visas in the past ten years.

Step seven: congratulations! Intense visa

After the case is reviewed and accepted by the Canadian Immigration Service, a letter called pass request is sent to the main applicant and any of the accompanying members, asking you to send the original of your passport to the Canadian embassy for the visa label. 

To do this, you need to do the Canadian visa pickup yourself in person or through a reputable company. Visa pickup usually takes a few weeks.

 


Apply for a Canadian visa separately: 

If your student’s spouse has received a student visa or your student’s child has entered Canada and now you are planning to apply for a mobile visa and join them in Canada, then you must apply for a work visa or a tourist visa. 

But this time you are the main applicant for your visa, and after creating an account and answering questions, you must choose your visa application from open Work Permit or Visit. 

The steps involved in applying for a mobile visa individually are almost the same as applying for a mobile visa simultaneously. The only difference is the type of questions. In one question, you are asked ” ” Are you the spouse, partner, or child of an international student who holds a student visa in Canada?”” 

In this answer to this question, you must select Yes as shown below.

 


Then you’re asked another question, ” Are you accompanying a family member who has a student status in Canada or has recently been approved for a student visa?” In answer to this question, you should also select Yes as shown below:

Other app questions relate to your personal information and it is necessary to answer them all correctly. The rest of the visa process is simultaneous, such as applying for a mobile visa, and you can follow the steps described in the previous section. That is, at the end, upload the necessary documents, pay the fees and submit the visa app. Then apply for a Canadian visa fingerprint and pick up your passport if you receive a passport.

 


How much does a Canadian mobile visa cost?

For a Canadian visa, whether it is a work visa or a tourist visa, you should consider several costs, including the cost of reviewing the case in the Canadian Immigration Service, the cost of fingerprinting and the cost of traveling to a third country to do fingerprinting, the cost of translating documents, and if you get help from an immigration lawyer, the cost of hiring a lawyer, as well as providing financial support.

Financial support

For a Canadian visa, the amount of financial support required varies depending on whether you apply for a visa simultaneously with the main applicant or separately.

When you apply for a Canadian visa as a student or student, you must pay for at least one year of your living expenses in Canada. 

As we mentioned in the previous section of the article, whether you apply for a visa with the main applicant at the same time or separately, this affects the amount of bank funds you have to provide, but it still costs one year.

Financial support required for the student or student who applies for a visa separately

If your spouse has obtained a student visa or if your student’s child has obtained a student visa and they have gone to Canada to study and now you are going to get a work visa or a tourist visa to join them you must provide the financial support you need as follows:

Financial support for a work visa

For a work visa that you apply for separately, you must provide a bank account for at least one year of living expenses in Canada. For example, if we consider the average cost of دلار 1,000 per month,the cost of a year is دلار 12,000,000. Because your spouse in Canada has already rented a place to live, so you don’t have to consider the cost of renting a house. 

Note: we recommend that Iranian applicants provide a higher amount for financial support so that the immigration officer makes sure that you do not add to your spouse’s expenses during your presence in Canada and that you can afford personal living expenses.

Financial support for a tourist visa

Since the maximum stay in Canada on a tourist visa is 6 months (renewable), if you consider the cost of living in Canada for a tourist visa to be at least ۲ 2,000,000 per month,you must show a total of ۱ 12,000,000 in bank funds. Of course, health insurance costs are added to the Canadian tourist visa.

We recommend that you provide a higher minimum for a Canadian tourist visa.


Visa issues for children in Canada

You or your spouse have a permit master or a permit work and are planning to take your child to Canada (child with a student visa)

If you or your spouse are currently residing in Canada, your child can study in preschool, primary or secondary school without a permit professor. By renewing your work or student position, your child will also renew his position. 

Child support: in most Canadian public schools, child support will be free. 
Children with children after legal age: be careful, when your child reaches the legal age of the province where you live, he must apply for a permit to continue his studies in Canada. This application can be made from within Canada.
Duration of the school student visa for children: if the parent has a work or study visa, the child’s visa will usually be until the end of the passport deadline or during the period of the parent’s study or work visa.  
When can children study without a permit teacher?

You and your child have a tourist visa and are in Canada, and your child goes to preschool or kindergarten. 

You or your spouse have a permit master or a permit work.

Can children on tourist visas study in Canadian schools?
Depends on the immigration position of the parents.

If one of the parents has a permit master or a permit work, there will be no problem with the child’s education without a permit master. Of course, only in schools. 

If the parent has no work or study or residence status and they have a tourist visa, the child can only study without a permit teacher in preschool and a permit teacher must be applied for studying in other sections.

 

Your child has a student visa and you go to Canada with him.

One or both parents enter Canada on a tourist visa with the student’s child. In this case, none of the accompanying parents can work or study. A relevant permit must be obtained if you wish to study or work. Read more about this on the Canadian student visa page. 

 


Does an international student in Canada need a permit professor?

To answer this question consider the following two modes: 

Children who are with their parents on Canadian soil and whose parents have a work or study permit are not required by Canadian government law to have a permit professor and can study in preschool, primary and secondary schools without a permit. 
Children who are outside Canada and intend to go to Canada with their parents who have a work visa or study visa can also accompany them with a tourist visa and enter Canada under Canadian law and do not need to obtain a Canadian permit teacher, but sometimes the Canadian Immigration Service may require the child to have a permit teacher, and once they enter the Canadian airport, the immigration officer may prevent the child from entering without a study permit. So be prepared for this situation and apply for a student visa in advance for your child if necessary.

Duration of the Canadian visa

If you apply for a visa with the main applicant (student or student) at the same time

In this case, your visa status depends on your spouse’s student visa or your child’s student visa. Whenever a student or student visa is issued, your visa is issued.  So in this case, the duration of a Canadian student visa should be considered, which usually lasts from a few days to four months. 

If you apply for a visa separately and after obtaining the visa of the main applicant (student or student)

In this case, if you apply for an open Work Permit or a visitor Visa, the time of check varies, which you can check on the Canadian Immigration Service website. 

After opening the Immigration Canada website, answer the three questions asked at the bottom of the page as shown below, and then hit the Get processing time button. Then you will see the average time to handle cases. Note, however, that your case may be processed sooner or later, and unfortunately, there is no warranty within the duration of the Canadian embassy’s response.

 


Converting a mobile visa to work in Canada

We’re going to look at the conversion of a mobile visa to a Canadian work visa in two ways.:

You are a Canadian student’s spouse and you enter Canada on a tourist visa

If you go to Canada on a tourist visa to see your student’s spouse,you can convert your tourist visa to an open Work Permit Visa. In this case, you need to have enough reasons to change your tourist visa to a work visa and register your app from inside Canada. 

The conditions, documents and procedures for applying for open work permit from inside Canada are the same as for applying from outside Canada, but the difference is during the time it takes to review the case and file an application “from inside Canada”. 

You are a student’s parents and you enter Canada on a tourist visa

If you apply for a tourist visa to accompany your student’s child, you can convert your tourist visa to a work visa after you arrive in Canada and if you get a job offer or a job offer from an authorized Canadian employer. 

The proposed work in the Canadian Occupational Classification system must be part of the TEER 0, 1, 2, 3 levels and the employer must obtain an LMIA license from the Canadian Ministry of Labour. 

Getting a Canadian work visa will make your child’s education in Canadian public schools free of charge. After a year of working, you can apply for permanent residence for yourself and your child. 

Extension of the Canadian visa

To renew your accompanying visa, you need to monitor the person on whom your visa depends (your spouse or child) and make sure that it is okay in every way. As long as the main person in the case is fine, you can apply for an extension of the accompanying visa.

Reasons for the rejection of a Canadian visa

Applications for Canadian mobile visas are usually rejected for the following reasons: 

The purpose of the trip is not convincing to the immigration officer of Canada.؛ 
Your financial support is not enough to cover the cost of living in Canada for at least a year؛
Your documents and reasons for returning to your country after the end of your spouse or child’s education are not enough؛
Your dependencies on the country of origin are weak or you have dependencies in Canada؛
The documents and information provided are incomplete or incorrect.
Your spouse’s education record states that you will remain in your country as your spouse’s sponsor (in cases where the application for a mobile visa is sent after the issuance of the spouse’s education visa).
